What is CBD Hemp Oil?

CBD hemp oil is extracted from the stalks of the industrial hemp plant. It is a natural substance that contains high levels of cannabidiol (CBD) and low levels of tetrahydrocannabinol (THC). The legal status of CBD hemp oil was a bit confusing until the passing of the 2018 Farm Bill on December 20, 2018.  This revised version of the Farm Bill cleared hemp’s name by clearly separating it from marijuana and opening up more leniency for U.S. farmers.

As of August 2020, there are ten states in which marijuana-derived CBD hemp oil is illegal for both recreational and medicinal use: Idaho, Indiana, Kansas, Kentucky, Mississippi, Nebraska, South Carolina, South Dakota, Tennessee and Texas.

On the flip side, there are currently twelve states where cannabis is legal for recreational and medicinal use: Alaska, California, Colorado, Illinois, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, Washington, and Washington D.C.

For the other 28 states, CBD derived from hemp is completely legal, but marijuana-sourced CBD oil either remains in a legal grey area or is only legal for medicinal purposes. These states are as follows:
