What is CBD Hemp Oil?
CBD hemp oil is extracted from the stalks of the industrial hemp plant. It is a natural substance that contains high levels of cannabidiol (CBD) and low levels of tetrahydrocannabinol (THC). CBD hemp oil has become an increasingly popular product and is sold in the form of capsules, drops, edible infusions, and more.
This shouldn’t be confused with hemp seed oil, which is nutritious but does not contain CBD.
Cannabidiol, also known as CBD, is one of the many cannabinoids that are found in the cannabis plant. A cannabinoid is a chemical compound that reacts with the cannabinoid receptors in cells. Cannabinoid receptors are located throughout the body and are a part of the endocannabinoid system (ECS). The ECS is responsible for keeping the body in homeostasis, among other things.
There are many misconceptions about the effects of CBD hemp oil. CBD oil can be derived from different varieties of the cannabis plant; however, the chemical makeup varies depending on the variety. CBD hemp oil is derived from industrial hemp and contains less than 0.3 percent THC. Therefore, CBD hemp oil does not contain the psychoactive properties of THC. In fact, CBD has been proven to counteract the properties of THC that get you high.
Is CBD Hemp Oil Legal in the United States?
So, is CBD hemp oil legal in the United States? The legal status of CBD hemp oil was a bit confusing until the passing of the 2018 Farm Bill on December 20, 2018. This revised version of the Farm Bill cleared hemp’s name by clearly separating it from marijuana and opening up more leniency for U.S. farmers.
CBD hemp oil is legal in the United States.
Legality of CBD Oil State-By-State (As of August 2020)
While Made By Hemp derives all CBD hemp oil from legal sources, other manufacturers may source their products from marijuana plants. This puts them in a tricky position in terms of who is legally able to purchase their products based on the state they live in. So, what does the law say about marijuana-sourced CBD?
On the federal level, cannabis is still considered a Schedule I substance, and while there are many states that have legalized it, there still remains a good chunk that have followed suit with the federal government.
As of August 2020, there are ten states in which marijuana-derived CBD hemp oil is illegal for both recreational and medicinal use: Idaho, Indiana, Kansas, Kentucky, Mississippi, Nebraska, South Carolina, South Dakota, Tennessee and Texas.
On the flip side, there are currently twelve states where cannabis is legal for recreational and medicinal use: Alaska, California, Colorado, Illinois, Maine, Massachusetts, Michigan, Nevada, Oregon, Vermont, Washington, and Washington D.C.
For the other 28 states, CBD derived from hemp is completely legal, but marijuana-sourced CBD oil either remains in a legal grey area or is only legal for medicinal purposes. These states are as follows:
- Arizona (Undecided)
- New Hampshire
- New Jersey
- New Mexico
- New York
- North Carolina
- North Dakota
- Rhode Island
- West Virginia
While local mandates can be a bit confusing, when you order from Made By Hemp, you’ll have the peace of mind knowing that our CBD hemp oil products are legal for purchase and consumption no matter where you live in the United States!
Legal Source of CBD Hemp Oil
Under the 2018 Farm Bill, CBD supplements are legal when sourced from hemp, which is defined as cannabis containing no more than 0.3% THC. The intoxicating compound, THC, is found in large quantities in marijuana (~10-80% depending on the strain and form) and is what gives it its recreational “high”. Hemp, however, cannot does not have that effect as 0.3% is such a small amount.
Sourcing hemp from U.S. farmers has lowered the cost on CBD hemp oil supplements, making it easier for anyone to add cannabinoid-rich hemp oil into their daily lives. Made by Hemp properly sources their hemp oil from the U.S. states of Kentucky and Colorado that exhibit the highest quality in growing and processing. Since we properly source our hemp oil, it is legal for customers in all of the United States.
Our Testing Process
When we receive the hemp oil from overseas, we test it right here in our Michigan lab. After doing our own testing, we also send a 1-gram sample to a third-party cannabis testing lab. At this lab, they use a High-Performance Liquid Chromatography to test its potency and check for impurities. If the results are adequate, we will begin using it to produce a variety of the hemp products we offer.
